A court passed resolution for the German airline Lufthansa to pay $1,500 compensation to the Azerbaijani citizen for damage.
On May 18, the Baku Appeals Court concluded the trial against the German airline Lufthansa with the demand to pay Elnara Rzazade for the damage, Lawyer Jabbar Hasanov told Trend News on May 18.
According to the Baku Appeals Court's resolution, Rzazade's complaint has been partially satisfied and the German airline Lufthansa must pay $1,500 compensation for the damage.
Rzazade's baggage which was returning from the United States to Azerbaijan was lost due to the German Lufthansa's fault. The defendants pleaded guilty, but refused to pay damages of $10,995, demanding to limit the amount described in the Warsaw Convention.
Under the convention, regardless of the value of missing items, ? 23 per kilo of lost luggage must be paid to the injured.
The plaintiff believes that even if the Warsaw Convention limits liability for damage caused to the owner of the property, this fact must be judged as a violation of property rights under Article 1 of Additional Protocol No. 1 of the European Convention on Human Rights and Basic Freedoms.
Rzazade intends to lodge an appeal with the Appeals Court of Baku.
