Chairman of Baku Court of Appeal supports specialization of judges

The chairman of the Baku Court of Appeal supports the specialization of judges in specific cases. Iman Nagiyev, the Chairman of the Baku Court of Appeal and the Election Committee of Judges appreciated the qualifications of judges in an interview with Trend.

Nagiyev said that the specialization of judges may be regulated by normative acts of the legislative body in the future. He said that judges have been appointed successfully on the basis of transparent procedures in accordance with international standards since 2005. He did not rule out the possibility that documents of people, wishing to hold the positions of judges, will be received in the nearest future.

Nagiyev said that the concrete work is underway to remove shortcomings in the judicial system, the organization of a progressive system. He said that while considering the cases, judges comply with legislation.

The Judicial Council has recently begun to launch disciplinary proceedings towards more than 120 judges. The activity of more than 50 judges was suspended. About 10 judges were transferred to lower-level positions.

He said that the regional appellate courts facilitate the opportunity to appeal to the higher courts, as well as give positive impact on the quality of the judges' decisions.

"About 44 judges worked in the appellate courts before July 2007. Today their number is 97. About 2,452 civil cases, 317 economic disputes, 559 criminal cases were considered in the first half of 2010 at the meetings of the Baku Court of Appeal, he said.

He said that significant changes occurred while adopting preventive measures by courts in the form of arrest.

"There were significant changes in terms of strict executing of the requirements of the law after the Plenum of the Supreme Court made decisions on "Practice of legislation used by courts when considering notions relating to the preventive punishment in the form of arrest", he said.

The plenum of the Azerbaijani Supreme Court appealed to the Judicial Council in November last year to conduct an investigation on the cases of judges who prefer arrest as a preventive measure. It made a decision for judges to justify their decisions on preventive measures in the form of arrest.

It was announced at the meeting of the Judicial-Legal Council in late December last year that Azerbaijan has initiated disciplinary proceedings towards 14 judges who have committed violations while sentencing in the form of arrest.

The Supreme Court and other instances were recommended to study and take into account the case law of the European Court of Human Rights in the jurisprudence by the presidential decree "Application of the law of the Azerbaijani Republic "Amendments to some legislative acts of the Azerbaijani Republic dated January 19, 2006.
