Supreme Court: Azerbaijani courts make shortages in consideration of drug related cases

The Azerbaijani Supreme Court discussed the courts' experience on the consideration of criminal cases involving illicit trafficking in narcotic drugs and psychotropic substances.

The Supreme Court’s plenum held n Friday was also attended by the law enforcement agencies’ heads, the Court told Trend.

The generalizations by the Supreme Court revealed that gaps are still observed in this sphere despite improvements in consideration of drug related crimes compared to previous years. The meeting noted that some trial courts make some shortcomings when considering such cases.

The meeting adopted the relevant decisions on the correct and uniform application of legislation in all drug related cases, as well as on the formation of a unified judicial experience in this field.

The generalizations studied all decisions of the first instance courts over such cases in 2009, as well as experience of application of the existing law and jurisprudence. The meeting also studied mistakes and omissions made in these cases.

The presidential decree dated June, 2008 approved the Law on trafficking in narcotic drugs and psychotropic substances and their precursors and other legal acts. Azerbaijan also adopted Also a new state program in this area that covers 2007-2012.

Articles 234-240 of the Azerbaijani Criminal Code covers crimes related to illicit trafficking in narcotic drugs and psychotropic substances. The meeting also considered the specific criminal and civil cases.

The meting was attended by Judicial-Legal Council Chairman and Justice Minister Fikret Mammadov, Prosecutor General Zakir Garalov, Interior Minister Ramil Usubov and Chief of the Azerbaijani Presidential Administration's Law Enforcement Agencies Work Department Fuad Alasgarov.
