Appellate court accepts Eynulla Fatullayev's appeal against Azerbaijani FM

The Baku Appellate Court will consider appeal of imprisoned editor-in-chief of Gundelik Azerbaijan newspaper Eynulla Fatullayev against Azerbaijani FM Elmar Mamedyarov, according to the Institute for Reporter Freedom and Safety.
Thus, the reason of the appeal is that Minister Elmar Mamedyarov did not respond to the information request sent to him. The court hearing is schedule for February 10.

On November 24 of 2008 the Yasamal district court decided to dismiss claim of editor-in-chief of the Gundelik Azerbaijan newspaper Eynulla Fatullayev.

Notably, a criminal case against editor-in-chief of the Gundelik Azerbaijan newspaper Eynulla Fatullayev was filed on the basis of the appeal of Foreign FMinister Elmar Mamedyarov to the Ministry of National Security.

The appeal said that after the publication of articles entitled "The Aliyevs go to war", foreigners residing in Azerbaijan, as well as entrepreneurs voiced their concern about this issue. In this connection Fatullayev sent a request to Mamedyarov to provide the list of persons who stated their concern, but the request was not responded.

Notably, the court of grave crimes sentenced Fatullayev is sentenced to 8,5 years in prison. The editor-in-chief is charged under articles 214.1 (threat of terror), 283.2.2 (inciting national, racial or religious enmity by a person with abuse of powers) and 213.2.2 (tax evasion) of the Criminal Code. The Appellate Court upheld the decision of the Court of Grave Crimes on the case of journalist Fatullayev.
