Famous lawyer: The conclusion of the marriage contract should be a mandatory procedure

According to him if earlier Azerbaijani legislation did not contain any concept of the marriage contract, after the New Family Code came in force in 2000, Article 38 of the Code provided for the conclusion of marriage contracts while creating a family, but on a voluntary basis.

"Unfortunately, Azerbaijan still has not institute for conclusion of marriage contracts", said he.

As for the reason of it, he said the main cause for the lack of such institute are peculiarities of our mentality.

"It is an obstacle for the realization of the Institute for the conclusion of marriage contracts. This is even more frustrating especially because the  analogue of a marriage contract was used in Azerbaijan when more developed countries did not even think of it", noted the lawyer.

"I insist that conclusion of a marriage contract should become obligatory", concluded the lawyer.
